Use of Products
Some products have been designed and are intended for off-road application only. These products are legal for racing vehicles only, which may never be used on public roads and highways. Federal and many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of this part may void the warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways.

Pricing Information
EINOXTUNING, LLC do their best to provide accurate product and pricing, however typographical errors or wrong manufacturer’s information may occur. EINOXTUNING, LLC cannot confirm the price of an item until after you order. In the event that a product is mentioned with an incorrect price or with any incorrect information, EINOXTUNING, LLC reserve the right, at our sole discretion, to refuse or cancel any order placed for that specific product. In the event that an item is priced incorrect, EINOXTUNING, LLC may, at our discretion, either inform you about the wrong price or the cancellation of your order. We try hard to provide you with low and reasonable prices in our shop as well as on the web shop at www.EINOXTUNING.com. However, sometimes there might be a price difference between the web shop and the store. In this case we will inform you about the correct and valid price. All prices are subject to change without prior notice. Please call for current prices and availability of products. We reserve the right to discontinue products as necessary because of quality, availability, price or other reasons.

Order Acceptance & Cancellations
Please speak directly to an EINOXTUNING, LLC sales representative to cancel an unshipped order. Cancellations are not accepted via email, fax, or voicemail. Cancellation requests on orders that have already shipped from EINXOTUNING, LLC or the manufacturer fall under the return guidelines. Many orders on specialty items are not cancellable under any circumstances. All cancelled orders are charged a 10% cancellation fee intended to pay credit card processing fees plus the fees to credit your account and to cover the cost for cancelling the order. Please note that there may be certain orders that we are unable to accept and must cancel. We reserve the right, at our sole discretion, to refuse or cancel any order for any reason. In some cases your order might be cancelled due to limitations on quantities available and errors in product or pricing information. We may also require additional verifications or information before we are able to accept your order.

Special Orders
All special order (personalized/specially fitted) items must be paid in full at the time of order. All special orders and custom orders will be processed in the most timely and efficient manner possible; however, EINOXTUNING, LLC cannot be held responsible for delays above and beyond its control. No cancellations, refunds, or exchanges on special order items or custom order items. Any refused shipment sent back to EINOXTUNING, LLC does not constitute the right to a refund or credit. It is the customer's responsibility to make all arrangements with EINOXTUNING, LLC for refused shipments.

Limitation  of Quantities
EINOXTUNING LLC reserves the right to limit the quantity of items purchased per person, per household or per order. These restrictions may be applicable to orders placed by the same account, the same credit card and also to orders that use the same billing and/or shipping address. We will provide notification to the customer should this situation occur.

Sales Tax
Appropriate sales tax will be added to all orders at checkout, as required by applicable law.

Backorder
We try to keep backorders to a minimum. If there is going to be an unreasonable delay, we will notify you of the approximate shipping date. Some items may be drop shipped from the manufacturer.

Payment
We accept payment through a variety of credit cards. All items shall remain the property of EINOXTUNING, LLC until paid for in full.

Shipping / Delivery Schedule
All Credit Card Orders can only be shipped to a verified billing address. Credit Card Orders will not be shipped until all information is verified and matched. All other orders or shop purchases (check, money order) will not be shipped until payment has been received in full and / or credited to our account. All unpaid orders will be cancelled after 15 business days. Shipping Charges are non-refundable. Once your order has been accepted, we will usually send out in-stock products within 1 business day unless we notify you otherwise. We cannot be held responsible for shipping delays, as these are generally beyond our control, especially with International orders. In the case of loss or damage during shipping, please contact us and keep all shipping cartons and all packing materials. In some cases we might request pictures of the product and / or packaging from you to initiate any claims with the carrier. You will need to allow us sufficient time to file an insurance claim and, until this is resolved in our favor, we cannot replace your product(s) nor issue a refund. You agree that if the insurer determines that the loss or damage is not an insurable loss, you shall remain responsible for the purchase. You agree to cooperate with the insurer in resolving insurance claims. Please also note that your credit card may be charged when your order is accepted, rather than when your order is shipped. All sales will be executed to only the lower 48 states and to international locations.

Returns
Returns are only allowed within 10 business days from the date of receipt and will be charged a general 20% restocking fee. All authorized return merchandise must be in UNUSED, UNINSTALLED , "AS NEW" condition and in its original saleable packaging. No return or exchange on merchandise that shows signs of having been installed, modified, mounted, scratched, or defaced will be allowed. No credits or refunds will be made for items returned in any unsatisfactory condition. These items will be returned to the customer at customer's expense. Some specialty items are not returnable, or refundable under any circumstances.  The customer is responsible for freight charges incurred with a return. You must fill in and fax the completed RMA (Return Merchandise Authorization) form to us and have a sales representative approve your return. EINOXTUNING, LLC will then issue you an RMA number. RMA numbers will expire 10 days after they are given to the customer. Items returned without an RMA number or using an expired RMA number will be refused. All returns must be shipped to the warehouse address of EINOXTUNING, LLC and have the RMA number clearly displayed on the outside of the package. The address is EINOXTUNING, 1036 NE Pine Island Road, Unit #6, Cape Coral, FL, 33909. It is the customer’s responsibility to see to it that any item returned to EINOXTUNING LLC  is insured. Damage, loss, or missing claims must be made with carrier by the customer. Unauthorized customer returns are not the responsibility of EINOXTUNING LLC. The Return Authorization Number does not imply a replacement or refund, but only that we will inspect the merchandise based on your claim. Returns must be sent freight prepaid and insured by you. A refund, exchange, or core return will not be considered until all relevant items, hardware, and accessories have been returned as well. Original shipping and handling charges are not refundable. All custom entry fees and duty associated with any return or exchanges will be charged to the customer. A photocopy of your invoice showing the invoice number and a contact telephone number where we may be able to reach you must accompany your authorized return. All approved refunds will be paid either by Company Check, Credit Card Credit, or Account Credit, to be determined by EINOXTUNING, LLC.

Shortages
All merchandise in the process of being packaged will be checked twice by two different people so shortages cannot happen. Claims for shortages therefore cannot be accepted.

Dealer Sales
All products offered on our online store can also be purchased by dealers for resale. If you are a reseller, you need to provide all necessary documentation first. Just download the DEALER APPLICATION or send us an e-mail to: sales@einoxtuning.com

Technical difficulties
In the event that our server and/or database encounters technical difficulties which causes problems with our product pricing, shipping calculations, sales tax computations or order acceptance, EINOXTUNING, LLC will correct all discrepancies at the time of processing. Customers will be notified of any errors and will have the option to continue with the order with corrected totals or to cancel the order. EINOXTUNING, LLC will not be held responsible for any miscalculated totals due to server/database errors.

Installation
All products require professional installation. The customer understands that some products may require modifications for correct fitment. Minor adjustments may be necessary as part of the normal installation process. All carbon fiber products will not sustain any force or weight, for they could be cracked by such force or weight. Some professional preparation may be necessary for an ideal fit. The buyer needs to perform these steps to his/her satisfaction before installation. If a body product needs to be painted the customer must pre-fit the parts to the vehicle before painting to ensure proper fit. Removal of reinforcements, bumpers, turn signals, and other safety equipment on the vehicle is the responsibility of the customer. EINOXTUNING, LLC will not be responsible for your own actions.

Warranty
Items deemed defective and under warranty may be returned for replacement only. Warranty items must be issued an RMA number (see above "return policy) from EINOXTUNING LLC. The customer is responsible for all shipping costs under a warranty claim. Returns must be shipped to EINOXTUNING, 1036 NE Pine Island Rd, Unit #6, Cape Coral, FL 33909. (unless a different address is given) with the RMA number written clearly on the box.  Customer warranties that are unauthorized or warranty products not meeting the warranty criteria of the manufacturer will not be honored and will be returned to the customer only if requested and at the customer's expense. The return of the warranty item to EINOXTUNING LLC is the sole responsibility of the customer. No other warranties are expressed or implied. EINOXTUNING LLC is solely responsible for product replacement under the above-stated conditions. Please call for specific warranty information on each product. Each manufacturer may supply different timeframes for their products, some products might only be returned under warranty if they arrived damaged or broken but have not been installed or used etc. Many parts are for off-road use only. As with any racing activity, there are risks at performance modifications. All installations are at the customers own risk. EINOXTUNING LLC holds no responsibility either implied or otherwise for mechanical, electrical or other failure when using aftermarket performance products. Some items listed are illegal in many states and only for racing vehicles which may never be used on a public highway.

To the maximum extent, permitted by law, in no event shall EINOXTUNING LLC or its  suppliers, agents, officers, owners, or employees and external consultants, or the successors, be liable for consequential, incidental, indirect or exemplary damages whatsoever arising out of or in any way relating to these terms or your use of or inability to use the website or the products, or the provision or failure to provide support services, including, but not limited to, lost profits, loss of confidential or other information, personal injury, failure, to meet any duty or any other claim for pecuniary or other loss whatsoever, or of any claim or demand against user by any other party, even if EINOXTUNING LLC has been advised of the possibility of such damages. These limitations shall apply notwithstanding any failure of essential purpose of any limited remedy. Notwithstanding any damages user may incur for any reason whatsoever the entire liability of EINOXTUNING LLC and any of its suppliers, agents, officers, directors, owners or employees and external consultants, or the successors under any provision of this agreement and your exclusive remedy for all of the foregoing shall be limited to the greater of the amount actually paid for any products ordered from EINOXTUNING LLC or one U.S. Dollar ($1). The foregoing limitations, exclusions, and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.

Privacy Policy
EINOXTUNING LLC. will not use or sell your email address or personal data to any 3rd party, with the exception that if EINOXTUNING LLC sells the majority of its assets or business, it may provide this data to the purchaser of the business so that they can continue providing service to our customers. We may collect any or all of the information that you give us depending on the type of transaction you enter into, including your name, address, telephone number, fax number and email address, together with data about your use of the website.  Other information that may be needed from time to time to process a request may also be collected as indicated on the website. We use the information collected primarily to process the task for which you visited the website. Any changes to our Privacy Policy will be placed here and will supersede this version of our Policy. Although we try to inform you about changes we make in a timely manner, we suggest that you read this document each time you use the website to ensure that it still meets with your approval.

Miscellaneous
In the case that any portion of this agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intensions of the parties and the remainder of the provisions shall remain in full force and effect. Our failure to insist upon or enforce strict performance of any provisions of this agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between parties nor trade practice shall act to modify any provision of this agreement. This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any dispute relating in any way to our webpage or to products you purchased from EINOXTUNING, LLC shall be submitted to arbitration Fort Myers, Florida, without regard to conflict of law probations. Arbitration under this agreement shall be conducted under the rules of the American Arbitration Association. We shall not be liable or deemed to be in default for any delay or failure in delivery under this agreement resulting directly or indirectly from acts of God, civil or military authority, acts of public enemy, war, riots, civil disturbances, insurrections, accidents, dire, explosions, earthquakes, floods, the elements, strikes, labor disputes, shortages of suitable parts, materials, labor or transportation or any cause beyond our reasonable control. In no event shall EINOXTUNING LLC be liable to any person for any damages of any kind, including, without limitation, those resulting from loss of data, loss of use, loss of profits, or other damage, in connection with any of our products and services, including all information, products and services, that are referenced or linked to the EINOXTUNING LLC webpage or any other information, software, products, downloads, documents, advice and information provided by EINOXTUNING, LLC. Venue for litigation of any dispute, controversy, or claim arising out of, in connection with, or in relation to this agreement, or the breach thereof, naming us as the defendant, shall be proper only in a court of Fort Myers, Florida. You consent to the exclusive jurisdiction of that court. In any action between us and User to enforce any of the terms of this agreement, we shall be entitled to recover expenses, including reasonable attorney’s fees. This agreement constitutes the entire agreement between EINOXTUNING, LLC and the customer.
